- INTRODUCTION AND ACCEPTANCE
1.1 Agreement
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Student", "you", "your") and The Elion Group Pty Ltd (ABN: [INSERT ABN]), trading as CAD For Formwork ("we", "us", "our", "the Company").
1.2 Acceptance
By enrolling in any course, purchasing any product, or accessing any content provided by CAD For Formwork, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not enrol in or access any course or content.
1.3 Clickwrap Agreement
Your acceptance of these Terms is confirmed when you tick the checkbox or click "I Agree" during the enrolment process. This constitutes your electronic signature and acceptance of these Terms.
1.4 Capacity
By accepting these Terms, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
1.5 Amendments
We reserve the right to amend these Terms at any time. Any amendments will be effective immediately upon posting on our website. Your continued use of our courses or content following any amendments constitutes your acceptance of those changes. - COURSE ENROLMENT AND ACCESS
2.1 Enrolment
Upon successful payment, you will receive access to the course materials and live sessions as outlined in the course description at the time of purchase.
2.2 Course Structure
Our courses include:
- Live sessions conducted via video conferencing (dates and times as specified)
- Pre-recorded self-paced study materials
- Reference guides and supporting documentation
- Practice exercises
2.3 Access Period
Access to course materials is provided for the duration specified in the course description. Unless otherwise stated, access to recorded materials is provided for 12 months from the date of enrolment.
2.4 Technical Requirements
You are responsible for ensuring you have the necessary technical requirements to access and participate in the course, including:
- A computer meeting the minimum specifications for Rhino software (as outlined on the Rhino website)
- Reliable internet connection for live sessions and video streaming
- Rhino software (trial or licensed version)
- Video conferencing software as specified
2.5 Course Commencement
Courses commence on the dates specified at the time of enrolment. It is your responsibility to be available and prepared for the scheduled start date.
- PAYMENT TERMS
3.1 Course Fees
Course fees are as displayed at the time of purchase, plus GST where applicable. All prices are in Australian Dollars (AUD) unless otherwise specified.
3.2 Payment Processing
Payments are processed through secure third-party payment processors. By making a payment, you agree to the terms and conditions of the relevant payment processor.
3.3 Payment Plans
If payment plans are offered and selected, you agree to make all payments according to the agreed schedule. Failure to make payments may result in suspension or termination of your course access.
3.4 Failed Payments
If any payment fails, we will attempt to contact you to resolve the issue. Continued failure to make payments may result in termination of access and referral to debt collection services. - INTELLECTUAL PROPERTY RIGHTS
4.1 Ownership
All course content, materials, methodologies, frameworks, teaching systems, branding, trademarks, logos, designs, text, graphics, videos, audio, software, and any other materials provided as part of or in connection with the course ("Course Materials") are the exclusive property of The Elion Group Pty Ltd and are protected by Australian and international copyright, trademark, and intellectual property laws.

4.3 Limited License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Course Materials solely for your personal, non-commercial educational purposes during the access period.
4.4 Restrictions
You expressly agree that you will NOT:
- Copy, reproduce, duplicate, download, store, distribute, share, publish, broadcast, transmit, or otherwise disseminate any Course Materials in any form or by any means
- Modify, adapt, translate, reverse engineer, decompile, or create derivative works based on any Course Materials
- Share, transfer, assign, sell, resell, license, sublicense, or otherwise make available any Course Materials to any third party
- Use any Course Materials for any commercial purpose, including but not limited to creating, developing, or teaching your own courses, training programs, or educational products
- Record, screen capture, photograph, or otherwise capture any live sessions or video content
- Remove, alter, or obscure any copyright notices, trademarks, or proprietary rights notices
- Use any Course Materials to compete with CAD For Formwork or The Elion Group Pty Ltd
- Share access credentials or allow any other person to access your account or the Course Materials
4.5 Teaching Methodologies
Our teaching methodologies, course structures, frameworks, systems, and approaches are proprietary trade secrets of The Elion Group Pty Ltd. You agree not to replicate, imitate, or use these methodologies for any commercial purpose.
4.6 Student-Created Content
Any content you create during or as a result of the course (including but not limited to models, drawings, documentation, exercises, and projects) based on our Course Materials, methodologies, or templates remains subject to the following:
- You may use such content for your own personal and professional work
- You may NOT use such content to create, develop, or deliver training or educational programs
- You may NOT claim our methodologies, frameworks, or teaching approaches as your own
4.7 Discussions and Collaborative Content
Any ideas, suggestions, feedback, or contributions you provide during live sessions or through course communications may be used by us without restriction, and you hereby assign all intellectual property rights in such contributions to The Elion Group Pty Ltd.
4.8 Survival
The intellectual property provisions of these Terms shall survive termination of your enrolment or access.
- ACCOUNT SECURITY AND PROHIBITED CONDUCT
5.1 Account Credentials
Your login credentials (username and password) are for your personal use only. You are responsible for maintaining the confidentiality of your account credentials.
5.2 Prohibition on Account Sharing
YOU ARE STRICTLY PROHIBITED FROM:
- Sharing your login credentials with any other person under any circumstances
- Allowing any other person to access your account or the course content through your credentials
- Using another person's credentials to access course content
- Logging in from multiple devices simultaneously (except as permitted for your own personal use)
5.3 Single User License
Your enrolment grants access to ONE (1) individual only. Each person wishing to access the course must enrol and pay separately.
5.4 Monitoring
We reserve the right to monitor login activity, IP addresses, device information, and usage patterns to detect unauthorised access or account sharing. Suspicious activity may result in immediate suspension of access pending investigation.
5.5 Consequences of Breach
Any breach of account security provisions will result in:
- Immediate termination of your access without refund
- Potential legal action for damages and breach of contract
- Reporting to relevant authorities where appropriate
5.6 Prohibited Conduct
In addition to the restrictions above, you agree NOT to:
- Use the course or Course Materials for any unlawful purpose
- Harass, abuse, or harm other students or staff
- Disrupt or interfere with the course delivery or other students' learning
- Submit false or misleading information
- Use automated systems, bots, or scrapers to access course content
- Attempt to gain unauthorised access to any systems or content
- REFUND POLICY
6.1 Australian Consumer Law
We comply with the Australian Consumer Law (ACL). Nothing in these Terms limits or excludes any rights you may have under the ACL that cannot be excluded by law.
6.2 Consumer Guarantees
Under the ACL, our services come with consumer guarantees that cannot be excluded. You are entitled to a remedy (which may include a refund) if our services:
- Fail to be provided with due care and skill
- Fail to be fit for the purpose you made known to us
- Fail to be delivered within a reasonable time (when no time is specified)
6.3 No Change of Mind Refunds
We do not provide refunds for change of mind. Once you have enrolled and received access to course materials, you have received the benefit of your purchase. Consider your decision carefully before enrolling.
6.4 Cooling-Off Period
We offer a 7-day cooling-off period from the date of enrolment. If you request a refund within this period:
- If you have NOT accessed any course materials: Full refund available
- If you HAVE accessed course materials: A partial refund may be considered at our discretion, less a reasonable administration fee
6.5 After Cooling-Off Period
After the 7-day cooling-off period, refunds will only be provided:
- Where required by Australian Consumer Law for a major failure
- In exceptional circumstances at our absolute discretion
6.6 How to Request a Refund
Refund requests must be made in writing to [email protected] and must include:
- Your full name and enrolment details
- The reason for requesting a refund
- Any supporting documentation
6.7 Processing Time
Refund requests will be processed within 14 business days. Approved refunds will be credited to your original payment method.
6.8 Non-Refundable Items
The following are not refundable:
- Software licenses (e.g., Rhino software) once activated
- Third-party products or services
- DISCLAIMERS AND LIMITATIONS
7.1 Educational Purposes Only
The Course Materials are provided for general educational purposes only. They do not constitute professional advice (engineering, construction, safety, legal, financial, or otherwise).
7.2 No Guaranteed Outcomes
We do not guarantee any specific results, outcomes, earnings, or career advancement from completing our courses. Your success depends on many factors including your effort, application, experience, and circumstances.
7.3 Use in Good Faith
The course is intended for basic training purposes and to be used in good faith. You agree to:
- Apply the knowledge gained responsibly and professionally
- Seek appropriate professional advice where required for specific projects
- Not rely solely on course content for safety-critical decisions
7.4 Fitness for Purpose
While we endeavour to provide high-quality, accurate, and current content, we do not warrant that the Course Materials will be suitable for any specific purpose beyond general education.
7.5 Technical Issues
We are not liable for any technical issues, interruptions, or failures beyond our reasonable control, including but not limited to:
- Internet connectivity issues
- Third-party software failures
- Video conferencing platform issues
- Your hardware or software failures
7.6 Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or related to these Terms or the course shall not exceed the amount you paid for the course.
7.7 Exclusion of Consequential Loss
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
- COURSE MODIFICATIONS
8.1 Content Updates
We reserve the right to update, modify, or change course content, materials, and structure at any time to improve quality, accuracy, or relevance.
8.2 Schedule Changes
While we endeavour to deliver courses as scheduled, we reserve the right to change dates, times, or delivery methods of live sessions with reasonable notice.
8.3 Cancellation by Us
If we cancel a course before commencement, you will receive a full refund or the option to transfer to a future cohort.
8.4 Force Majeure
We are not liable for any delay or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, or technical failures. - STUDENT CONDUCT AND EXPECTATIONS
9.1 Active Participation
To get the most from the course, you should:
- Attend live sessions as scheduled
- Complete self-paced study materials between sessions
- Submit exercises and practice work
- Engage respectfully with other students and instructors
9.2 Falling Behind
The course is cumulative—each week builds on the previous. If you fall more than two weeks behind, you must contact us to discuss options, which may include:
- A catch-up plan
- Transfer to a future cohort
9.3 Respectful Behaviour
You agree to conduct yourself respectfully and professionally in all interactions with staff and other students, including during live sessions, in any community forums, and in email communications.
9.4 Academic Integrity
You agree to complete your own work and not submit work completed by others (including AI-generated content) as your own.
- PRIVACY
10.1 Privacy Policy
Your personal information is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
10.2 Information Collection
We collect personal information necessary to:
- Process your enrolment and payments
- Deliver the course and communicate with you
- Improve our courses and services
10.3 Recordings
Live sessions may be recorded for the purpose of providing course materials to enrolled students. By participating in live sessions, you consent to being recorded.
- TERMINATION
11.1 Termination by You
You may withdraw from the course at any time by notifying us in writing. Refunds for withdrawal are subject to the Refund Policy above.
11.2 Termination by Us
We may suspend or terminate your access immediately and without refund if you:
- Breach any provision of these Terms
- Share login credentials or allow unauthorised access
- Copy, distribute, or share Course Materials
- Engage in disruptive, abusive, or inappropriate behaviour
- Fail to make required payments
11.3 Effect of Termination
Upon termination:
- Your access to Course Materials will be revoked immediately
- You must delete any Course Materials in your possession
- The intellectual property and confidentiality provisions survive termination
- You remain liable for any outstanding payments
- GENERAL PROVISIONS
12.1 Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
12.2 Entire Agreement
These Terms, together with our Privacy Policy and any course-specific terms, constitute the entire agreement between you and us regarding the subject matter hereof.
12.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12.4 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
12.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
12.6 Notices
All notices to us must be sent in writing to [EMAIL ADDRESS]. We may send notices to the email address associated with your account.
12.7 Interpretation
